1.    High Court to rule on pensioners' right to pre-2013 arrears, affecting 930,000 retirees

The High Court is set to decide on Dec 4 if over 930,000 pensioners can enforce a Court of Appeal mandamus order requiring the government to pay pre-2013 pension adjustment arrears starting January 2022. This follows a Federal Court ruling that the 2013 Pension Adjustment Act amendment contravened Article 147 of the Constitution by being less favorable to pensioners.

2.    Ex-judges who retired prior to July 2015 have received pension arrears, while rest received salary revision and arrears

In November 2024, several retired judges confirmed receiving arrears and revisions to their pensions following the Federal Court's ruling that the Judges’ Remuneration Amendment Act 2014 was unconstitutional. Despite receiving payments, 37 ex-judges continue legal action against the government over pension adjustments, after the 2015 amendments were deemed to violate constitutional protections of their pension rights.
